Establishing Parentage in Yorkville

Under the Illinois Parentage Act of 1984 (750 ILCS 45/), there are several ways that the paternity, or parentage, of a child can be established. These include:

• If the father and mother sign a Voluntary Acknowledgement of Paternity (VAP) – this is often done at the hospital when a baby is born to unmarried parents;
• The State of Illinois Department of Healthcare and Family Services' (HFS) Child Support Services enters an Administrative Paternity Order; and
• A judge enters an Order of Paternity.

When the paternity of a child is disputed, the last two scenarios come into play. Generally, HFS will attempt to establish paternity using DNA testing. If, for some reason, HFS cannot establish paternity, the court will step in. Both parents must be present at a paternity hearing, but if the father is absent, the court can enter a judgment of paternity without him.
